Ofcom has published a letter which it sent to communication providers in scope of the One Touch Switch (OTS) rules, stating that it considers it appropriate to retain the existing Notification of Transfer (NoT+) functionality for a limited period beyond 12 September 2024 in light of progress of the OTS industry trials. Despite a large number of customers being successfully switched to using OTS, the current levels do not indicate that all customer switches will be able to follow the OTS process by the planned 12 September 2024 launch date. Ofcom is therefore asking Openreach, KCOM and wholesalers who operate NoT+ not to remove the existing functionality for a period of six weeks, to ensure that NoT+ can be used as a back-up option. Ofcom has stressed, however, that OTS should be used in the first instance for all switches, with NoT+ only used where it is not technically possible to proceed with the switch through OTS.

These changes implement Ofcom's previously consulted policy decisions and aim to reflect evolving spectrum management objectives.

The regulator received responses from major stakeholders including the British Broadcasting Corporation, ITV, and Sky, and plans to consult on its first designation recommendations in summer 2025. The new regime requires designated platforms to make public service broadcaster content easily accessible and prominent.

Ofcom has fined AVS Group Ltd £1 million for failing to implement robust and highly effective age-assurance measures on its adult websites. The regulator also imposed a further £50,000 penalty for not responding to legally binding information requests. Ofcom found that the age-assurance systems used by AVS were not “highly effective,” as required under the Online Safety Act 2023 (OSA 2023) to prevent children from readily accessing adult content. Ofcom has ordered AVS to introduce compliant age-assurance measures within 72 hours of the decision or face additional daily penalties of £1,000. The company will also incur a further £300 per day for failing to respond to Ofcom’s information request, starting tomorrow, until it complies or for up to 60 days, whichever comes first.

The penalty, which will be passed to HM Treasury, was calculated by reference to the size and turnover of the service.
