PRACTICE NOTES
This Practice Note provides a snapshot of some of the key provisions in the Fisheries Act 2020 (FiA 2020), which has been described as the UK’s first domestic fisheries legislation in 40 years. The FiA 2020 received Royal Assent on 23 November 2020. FiA 2020, s 54 made provision for a delayed entry into force of certain sections and schedules. Since 1 March 2021, all parts of the Act have been in force. From 31 December 2020, the UK Government has had the power to exercise complete control over who is permitted to fish in UK waters. The FiA 2020 sets out provisions in relation to fisheries, fishing, aquaculture and marine conservation, establishing a legal framework for the regulation of fisheries in the UK and empowering the government to make detailed secondary legislation for the same purpose. Private Client analysis: This forms another in a list of cases where HMRC have successfully challenged a claim for BPR in property based businesses. The deceased was running a wild fisheries business from 27 acres of land including a river and tributaries. The claim also covered 2/7 of her home, on the basis this was used to run the business and host customers. She ran the business for 17 years following her husband's death, and worked long days to maintain the river and banks and manage the bookings and activities. However, the court held that the nature of the non-investment services did not prevent the usual characterisation of the business, being one whose income was derived from property, as being that of an investment business. Significant additional services, such as catering, tuition, or equipment hire are noted as hypothetical points that may have changed the outcome. Local Government analysis: In this wide-ranging appeal against the Secretary of State for Education’s decision to permanently prohibit a teacher who engaged in alleged inappropriate sexual behaviour towards pupils, the Administrative Court of the Kings’ Bench Division explored at length whether the Teacher Misconduct Regulations and governing disciplinary procedures and legal advice issued within Teaching Regulation Agency proceedings are fit for purpose. Dismissing every ground of challenge brought by the appellant, the court upheld the prohibition order recommended by the Professional Conduct Panel, drawing a clear distinction between professional discipline regulatory proceedings designed to safeguard pupils and protect the public interest, in contrast with criminal proceedings that are punitive in nature and engage a higher standard of proof. This case provides further judicial analysis as to the use of hearsay evidence, good character directions and inferences that can be made in respect to sexual gratification, while underlining the importance of ensuring that pupils are protected from the potential harm that can arise where those entrusted to teach engage in serious misconduct towards them.
