Latest developments On 7 January 2016, the CMA formally cancelled its phase 2 investigation into the anticipated acquisition following the parties announcement (and the CMA receiving assurances from the parties) that they had abandoned the transaction. Parties Fenland Laundries Limited (Fenland) is based in Skegness, Lincolnshire. Fenland currently operates under a joint venture agreement with Berendsen Cleanroom Services Limited (Berendsen) under the Micronclean trademark. ARCHIVED: This Practice Note has been archived and is not maintained. The common law recognises two sorts of highway ferry and distinguishes them by where they run. One sort runs from town to town or to a particular island and the other more common sort connects two specific highways, one on each side of an intervening waterway. The Highways Act 1980 (HiA 1980) expressly excludes ferries from its definition of a highway, but the common law view of ferries is that they are similar to highways, with very particular rights and obligations. Pensions analysis: This was the second limb of a Part 8 Claim, the purpose of which was to mitigate the losses of the claimant (Avon) and the 1st to 6th defendants (Trustees) caused by allegedly negligent advice from former scheme advisers. It took the form of an application to approve a compromise, which had been negotiated between the counsel teams acting for Avon and the 7th defendant, a representative beneficiary appointed pursuant to CPR 19.9. The substance of the claim was a Re Courage-type fetter on the amendment power, and whether amendments made in 2006 which had resulted in the accrued final salary benefits being linked instead to statutory revaluation, had lawfully broken the final salary link. The judge approved the compromise, the key term of which was that those members who would have received more valuable benefits as they retained their final salary link, received 70% of that additional value. A piece of land held by a feuar or vassal who traditionally paid feu duty (a type of rent) to the feudal superior and who became the effective owner subject to complying with the conditions of the feu.
