The European Securities and Markets Authority (ESMA) has delivered its opinion on the draft revised European Sustainability Reporting Standards (ESRS) developed by the European Financial Reporting Advisory Group (EFRAG). ESMA welcomes EFRAG’s proposed changes to the ESRS and finds room for specific modifications. The Commission will now consider ESMA’s opinion alongside opinions submitted by the European Banking Authority (EBA), the European Insurance and Occupational Pensions Authority (EIOPA), the European Central Bank (ECB) and other public bodies, with the aim to adopt the revised ESRS into a delegated act by summer 2026.

This Practice Note considers how the scope of the right to reside in the EU which results from EU citizenship, first recognised by the Court of Justice in Ruiz Zambrano, has been narrowed in subsequent judgments and its application confined to specific circumstances. The recognition of EU citizenship rights in Zambrano The decision of the Court of Justice in Gerardo Ruiz Zambrano v Office national de l'emploi represented a turning point in an emerging law of EU citizenship that bestows on EU citizens, but more particularly their family members, a free-standing and enforceable right of residence distinct from the rights recognised under EU free movement law, under Directive 2004/38/EC, the Citizens’ Directive. In brief, the facts of the case were that two married Colombian nationals claimed asylum in Belgium. Although the asylum claim was unsuccessful, they could not be removed. Two children were born to the couple in Belgium. The children did not acquire Colombian nationality nor were they registered as Colombian nationals. They were granted Belgian nationality in order to avoid them being stateless.

The European Commission's Union Database for Biofuels (UDB) has opened for online registration by the relevant economic operators of transactions of liquid renewable and recycled carbon fuels. The UDB is a global traceability tool, which traces consignments of renewable and recycled carbon fuels and the raw materials that have been used for their production. The database will improve market transparency and traceability in the supply chain for such fuels, avoid double counting and minimise the risk fraud and irregularities, which will support efforts to meet the EU decarbonisation targets.
