The European Commission has published a letter that was sent to the chair of the joint committee of the European Supervisory Authorities (the ESAs) which addresses a draft Delegated Regulation on subcontracting information and communication technology (ICT) services supporting critical or important functions (the RTS), submitted by the ESAs on 17 July 2024. In the letter, the Commission rejects the draft RTS on the basis that it considers the provisions relating to the monitoring of the subcontracting chain as not being within the scope of the mandate set out in Article 30(5) of the Digital Operational Resilience Act (DORA).

The European Commission has published its 2nd report on the application of the EU’s General Data Protection Regulation, Regulation (EU) 2016/679 (EU GDPR), on 25 July 2024. The report found that the EU GDPR efficiently delivered strong protection for data subjects and risk-based obligations for controllers and processors. The report also highlighted specific key areas to enhance the application of the EU GDPR, which included an adoption of the Commission's proposal for an EU GDPR Procedural Regulation to enable vigorous enforcement with swift remedies. It further urged data protection authorities to support small operators and SMEs with consistent interpretation and enforcement of the EU GDPR to ensure a coherent application across the EU.

The April 2024 infringement includes reasoned opinions, Court of Justice of the European Union referrals and formal notice letters issued to France for failing to correctly transpose Directive 2008/98/EC on waste as amended by Directive (EU) 2018/851, the EU Waste Framework Directive, to Austria for failing to correctly transpose Directive 2011/92/EU as amended by Directive 2014/52/EU into national legislation, the EU Environmental Impact Assessment Directive, to Lithuania for failing to correctly incorporate Directive (EU) 2015/2193 into national legislation, the EU Directive limiting air pollutants from medium combustion plants, among other issues.

The December 2024 infringement includes letters of formal notice to Sweden for failure to comply with the Water Framework Directive and Bulgaria for not complying with the Directive on public procurement and the Digital Services Act. Reasoned opinions were issued to Poland in relation to the Bathing Water Directive, Croatia, Poland, Slovenia and Sweden for their failure to transpose the EU Blue Card Directive, and Sweden for not fully transposing the Corporate Sustainability Reporting Directive into national laws. The UK has been referred to the Court of Justice for not complying with EU law on free movement of EU citizens and their family members at the end of 2020 and for failing to terminate the Bilateral Investment Treaties still in force with Bulgaria, the Czech Republic, Croatia, Lithuania, Poland and Slovenia.

The January 2025 infringement package includes formal notice letters issued to 27 Member States for failing to notify full transposition measures for eleven EU Directives covering corporate, environment, financial services, justice, taxation, and transport matters.

The January 2026 infringement includes letters of formal notice issued to a range of Member States for failing to notify complete transposition measures of multiple directives (including on financial services contracts concluded at a distance – Directive (EU) 2023/2673, on credit agreements for consumers – Directive (EU) 2023/2225, and on crypto-asset tax transparency – Directive (EU) 2023/2226), and for failing to notify national measures transposing the Directive (EU) 2023/2123 aligning information exchanges on terrorist offences with data protection rules, among other issues.
