The European Securities and Markets Authority (ESMA) has published joint guidelines aimed at promoting consistency in the regulatory classification of cryptoassets pursuant to Article 97(1) of the Markets in Cryptoassets Regulation (MiCAR), alongside official translations. The guidelines provide templates for explanations and legal opinions required under MiCAR, and a standardised test for classifying cryptoassets. As the official translations have now been published on the ESMA website, the guidelines will apply in two months’ time at which point competent authorities to which these guidelines apply must notify the European Banking Authority, the European Insurance and Occupational Pensions Authority or ESMA, as the case may be, whether they (i) comply, (ii) do not comply, but intend to comply, or (iii) do not comply and do not intend to comply with the guidelines.

The European Securities and Markets Authority (ESMA) has published guidelines to prevent and detect market abuse under the Markets in Cryptoassets Regulation (Regulation (EU) 2023/1114) (MiCA), alongside official translations. The guidelines aim to establish consistent, efficient and effective supervisory practices among competent authorities to prevent and detect insider dealing, unlawful disclosure of inside information and market manipulation. As the official translations have now been published on the ESMA website, the guidelines will apply in three months’ time. Competent authorities to which these guidelines apply must notify ESMA within two months whether they: (1) comply; (2) do not comply yet but intend to comply; or (3) do not comply and do not intend to comply with the guidelines.
