Armstrong v Armstrong (remedy)—satisfying the equity arising from proprietary estoppel, with an alternative award under the Inheritance (Provision for Family and Dependants) Act 1975

Private Client analysis: Having found that the claimant had established his claims in proprietary estoppel and under the Inheritance (Provision for Family and Dependants) Act 1975 (I(PFD)A 1975) at trial (Armstrong v Armstrong [2024] EWHC 2989 (Ch)), the court went on to consider the appropriate remedy, aiming to achieve as clean a break as possible between members of the same farming family whose business affairs were closely entwined. The Court also considered the appropriate award under the I(PFD)A 1975 in the alternative, in case the finding of an estoppel should be overturned upon appeal. MHCLG publishes template access agreement for buildings covered by Developer Remediation Contract

The Ministry of Housing, Communities and Local Government (MHCLG) has published a template access agreement and accompanying guidance to assist developers and responsible entities in agreeing terms for developer access to buildings covered by the Developer Remediation Contract (DRC). The template is intended to facilitate developer entry to conduct fire safety surveys and assessments required under the DRC. MHCLG notes that using the template may help expedite building assessment and remediation work, but emphasises that the materials do not constitute legal advice and advises parties intending to use the template to seek independent legal counsel.
