CPR changes—31 December 2025

Changes are provided for in the Civil Procedure (Amendment No 3) Rules 2025, SI 2025/1229 which come into force on 31 December 2025. The rules amend CPR 77, provisions which support criminal justice. The rules insert a new section setting out the procedure to be followed where, under section 32ZAA of the Crime (Sentences) Act 1997 or section 256AZBA of the Criminal Justice Act 2003, the Secretary of State directs the Parole Board to refer its direction to release a prisoner to the High Court. The rules also set out the procedure for applying for non-disclosure of information which would adversely affect the prevention of disorder or crime, or the health or welfare of the defendant or any other person.

Dispute Resolution analysis: The minutes of the Civil Procedure Rule Committee (CPRC) meeting of 3 October 2025 (conducted in a hybrid format at The Rolls Building (Royal Courts of Justice) and via video conference) cover a number of issues including reforms to closed material procedure (CMP) under CPR Part 82, proposed consultation on traffic enforcement, amendments to PD 52D arising from the Anaesthesia Associates and Physician Associates Order 2024 (AAPAO 2024), clarification of the route for Human Rights Act damages claims, the fixed recoverable costs (FRC) interim stocktake, developments in costs budgeting pilots, revisions to anonymity orders, and matters before the Lacuna Sub-Committee concerning interpreters’ fees and non-party disclosure.

RICS submits Budget 2025 recommendations and warns on landlord NI proposals

The Royal Institution of Chartered Surveyors (RICS) has submitted recommendations to HM Treasury ahead of Budget 2025, calling for business rates reform, enhanced local authority powers, accelerated green investment targets and planning system improvements. RICS has also raised concerns about reported proposals for an 8% National Insurance charge on landlord rental profits, citing commissioned research suggesting 62% of landlords would raise rents in response and 40% would reduce property improvements.
