The Pensions Ombudsman (TPO) has produced a factsheet about its Early Resolution Service (ERS), outlining its purpose, its complaints assessment procedure and the process as a whole. The factsheet states that if the ERS is unable to reach a resolution (or if either party doesn’t want to engage the ERS), the issue is passed on to the Adjudication Team for a new, formal investigation in which the parties will be able to submit additional information and arguments to the Adjudicator, who then produces an Adjudicator’s Opinion. Should any party disagree with the Adjudicator’s Opinion, they can request referral to the Pensions Ombudsman, who will issue a binding and enforceable Determination which is final (subject to a successful appeal on a point of law).
