This case concerns a claim brought by the National Guild of Removers and Storers Ltd against Bee Moved Ltd and its two directors/shareholders for passing off. The case was heard in the Intellectual Property Enterprise Court (IPEC) by Douglas Campbell QC sitting as a Recorder. Although the claimant succeeded in relation to advertisements appearing on the defendants’ website, its claim in relation to advertisements appearing on a third party website failed. In addition, some of the claimant’s submissions in relation to the third party website were not allowed.
