IP essentials

The IP essentials subtopic provides a basic overview of IP law. It is aimed at commercial lawyers not specialised in IP.

What is intellectual property?

The World Intellectual Property Office defines IP as ‘creations of the mind, such as inventions; literary and artistic works; designs; and symbols, names and images used in commerce’. Broadly, the aim of IP law is to cultivate an environment in which creativity and invention can flourish.

In the UK, IP rights are registered with the Intellectual Property Office (IPO) though there are other entities which register rights at an international level.

The four most common IP rights are: patents, trade marks, designs and copyright. Other available IP rights and associated rights include: database rights, plant variety rights, semiconductor topography rights, geographical indications, trade secrets, confidential information and know-how. There are rights to prevent passing off and protection may also be available for spare parts and image rights.

MHCLG publishes Commissioners’ third report and ministerial response on Birmingham City Council intervention

The Ministry of Housing, Communities and Local Governmengt (MHCLG) has published the Commissioners’ third report on the intervention at Birmingham City Council, alongside the ministerial response. The report records progress of the intervention at the Birmingham City Council, since January 2025, reporting progress in in key service areas, the establishment of a Corporate Plan and a framework agreement on Equal Pay, but highlights ongoing significant risks including the waste dispute which delayed progress, financial libility risks from the Equal Pay framework, slow cultural and governance reform, and the need for a stronger corporate approach to transformation. Commissioners intend to produce an Exit Plan by January 2026 to set out the improvements required before the intervention ends in October 2028. The ministerial response welcomes recent progress but stresses the need to strengthen governance and leadership behaviours, deliver budgeted savings, stabilise finances, resolve equal pay liabilities and maintain momentum ahead of major milestones in 2026. Commissioners are expected to submit their next report, including an exit strategy, by May 2026.

Planning Inspectorate completes rollout of digital appeals service to all LPAs

The Planning Inspectorate has completed the national rollout of its new digital appeals service to all local planning authorities (LPAs) in England, enabling online management of Householder, Planning (S78) and Listed Building (S20) appeals. The service will add Commercial Planning, Commercial Adverts and Advertisements appeals on 17 December 2025, followed by Enforcement and Lawful Development Certificate appeals in February 2026. The new system will eventually replace the Appeals Casework Portal, though existing cases will continue on the old platform while new cases use the digital service exclusively.

IOPC publishes Hillsborough investigation findings on police conduct and misconduct

The Independent Office for Police Conduct (IOPC) has published a report summarising investigations into police conduct during the Hillsborough disaster and its aftermath. The IOPC conducted 161 separate investigations into 352 complaints, finding that South Yorkshire Police's Chief Constable and nine other officers would have faced gross misconduct cases if still serving, while two West Midlands Police senior officers would also have faced gross misconduct proceedings for bias in their investigation of the disaster.

Welsh Government publishes written statement on progress toward new national body for youth work

The Welsh Government has published a written statement, by Cabinet Secretary for Education, Lynne Neagle MS, providing an update on work to establish a national body for youth work in Wales, confirming that the first meeting of the body’s delivery board has taken place to support the creation of the new body, ensure progress against milestones, and provide leadership, advice and challenge on remit, funding, governance and stakeholder engagement. Members of the board have also been announced. The statement also confirms the decision to finalise the draft statutory framework for youth work, comprising statutory directions and statutory guidance, which will be brought into force by April 2026. The framework will introduce a new planning and reporting structure enabling Welsh Ministers and young people to hold decision makers to account, and will require local authorities to produce five-year strategic plans in close collaboration with the voluntary sector and other partners, with the first plans expected to commence in April 2027 following a development period from early 2026.
