ISDA and industry bodies seek delay on EMIR 3.0 third-country CCP reporting requirements

The International Swaps and Derivatives Association (ISDA) and nine other industry bodies sent a letter to the European Commission on 21 October 2025 requesting guidance indicating that firms should not report third-country central counterparty clearing (CCP) activity under Article 7d of the European Market Infrastructure Regulation (EMIR) 3.0 until the corresponding regulatory and implementing technical standards are finalised. They argued that requiring reporting before these technical standards are complete would create operational complexities and additional costs, without enhancing regulatory transparency.

ESMA publishes final report on RTS for EU code of conduct on issuer-sponsored research

The European Securities and Markets Authority (ESMA) has published its final report on the draft regulatory technical standards (RTS) for establishing an EU code of conduct for issuer-sponsored research. Developed under Article 24(3c) of the Markets in Financial Instruments Directive (MiFID II) and the Listing Act Directive, the RTS set out procedural and organisational requirements intended to support the production and distribution of issuer-sponsored research within a harmonised framework. If endorsed by the European Commission, the regulation will apply from 6 June 2026.

ESMA publishes RTS on open-ended loan-originating AIFs

The European Securities and Markets Authority (ESMA) has published draft regulatory technical standards (RTS) on open-ended loan-originating AIFs (OE LO AIFs). The draft rules determine the requirements with which LO AIFs must comply to maintain an open-ended structure. The draft RTS were mandated under the AIFMD and have been submitted to the European Commission (EC) for adoption. ESMA draws stakeholders’ attention to the inclusion of these RTS on the list of the non-essential Level 2 acts that the European Commission will not adopt before 1 October 2027 at the earliest.

The European Securities and Markets Authority (ESMA) has published a final report on the draft implementing technical standards (ITS) on the extension of the use of the alleviated format of insider lists. Annex III contains the draft ITS.
