If a commercial lease excluded sections 24–28 of the Landlord and Tenant Act 1954 (LTA 1954) and a subsequent renewal lease did not contain any such exclusion, does this mean that the renewal lease was not contracted out? Can a landlord claim rent for a period after a lease has expired?

The Landlord and Tenant Act 1954 (LTA 1954) provides security of tenure to business tenants in occupation of leasehold property if certain conditions are met. It is possible to exclude the effects of LTA 1954 only if the procedure set out in LTA 1954, s 38A is followed.
