Regulated mortgage contract definition

What does Regulated mortgage contract mean?

This is a type of regulated investment defined in the Financial Services and Markets Act 2000 (Regulated Activities) Order 2001, SI 2001/544, art 61(3).

It has the following characteristics: it is a first legal charge over property in the United Kingdom; the borrower is an individual or trustee; at least 40% of the property is occupied by the borrower or a member of their immediate family, or is intended for their occupation. Exempt professional firms must comply with rules 3(l) and 5(7) of the Scope Rules in respect of regulated mortgage contracts.
