191.     When premiums will not be returned.

The Partnership Act 1890 gives the court no jurisdiction to order the return of premiums either on the death of a partner1, or if the dissolution is, in the judgment of the court, wholly or chiefly due to the misconduct of the partner who paid the premium2, or when the partnership has been dissolved by an agreement containing no provision for a return of any part of the premium3.

Neither will the court grant the relief if the partner seeking the return of his premium has expressly or impliedly waived this
