309. Liability of carriers for clandestine entrants: detention of vehicles.

Where a penalty notice has been issued in respect of responsibility for a clandestine entrant1, a senior officer2 may detain any relevant vehicle, small ship3 or small aircraft4, or the rail freight wagon in which the clandestine entrant arrived in the United Kingdom, as the case may be, until all penalties to which the notice relates, and any expenses reasonably incurred by the Secretary of State in connection with the detention,
