Once Ofcom1, in exercising its powers to grant local radio multiplex licences2, has secured the amount of digital capacity that is to be reserved to the BBC on the grant of the licence3, Ofcom must publish, in such manner as it considers appropriate, a notice (a 'tender notice')4, which must:
(1) state that Ofcom proposes to grant a local radio multiplex licence5;
(2) specify the frequency on which the service is to be provided6;
(3) specify, in such manner as Ofcom considers appropriate, the area or locality in the United Kingdom7 in which it is to be available8;
