1: COMMENCEMENT AND PROGRESS OF WORK

49 Date of commencement

The contract may specify a date for commencement of the works1, or it may empower the employer to select this date and to notify the contractor accordingly2. In either case, provision of the site by the employer will be a condition precedent to the contractor’s obligation to commence work3, although a contractor who accepts late possession and starts work will be deemed to have waived the condition4.
