25.3 Contracts relating to land

The convention is to label all documents which relate to negotiations for the sale of land ‘subject to contract’ (including drafts of the formal contract). This practice may be thought unnecessary following the implementation of the Law of Property (Miscellaneous Provisions) Act 1989 Section 2, particularly as many land transactions cannot come into existence unless a written contract is signed by parties (or on their behalf). Section 2 provides that:
