Where a new tenancy is granted on or after 28 February 1997 and the landlord or (as the case may be) at least one of the landlords was, immediately before the grant, a landlord or licensor under an assured agricultural occupancy and the tenant or (as the case may be) one of them was the tenant or licensee under that assured agricultural occupancy, then the new tenancy will be an assured agricultural occupancy and it is not open to the landlord to attempt to avoid that result by serving notice in the
