429 Fixed term tenancies

If the landlord wishes to terminate a fixed term tenancy before the contractual expiry date (and assuming there is no provision in the tenancy agreement permitting earlier termination), the landlord can only rely upon certain limited grounds in the Housing Act 1988 Schedule 2. These grounds are: four mandatory grounds, namely Grounds 2, 7 (but not in the case of Wales), 7A or 81; and secondly, seven discretionary grounds, namely Grounds 10 to 15 inclusive and 172.

Even if one, or more, of the above grounds are available, the landlord must also show that the tenancy agreement
