Commission Nationale de l’Informatique et des Libertés (CNIL) has fined Google LLC and Google Ireland Limited €325m for violating French data protection and electronic communication laws. The decision followed a complaint lodged by the organisation None Of Your Business (NOYB) in August 2022, prompting CNIL to conduct inspections throughout 2022–23. CNIL found that Google inserted advertisements as emails in Gmail’s 'Promotions' and 'Social' tabs without users’ prior consent, breaching Article L.34-5 of the French Post and Electronic Communications Code, and failed to properly inform users about advertising cookies during account creation, rendering the consent invalid under Article 82 of the French Data Protection Act. As a result, CNIL’s restricted committee imposed fines of €200m on Google LLC and €125m on Google Ireland Limited. The companies must also stop displaying advertisements between emails without prior consent and ensure valid consent for advertising cookies during account creation. These measures must be implemented within six months, or a daily penalty of €100,000 will be imposed on each entity.

The Commission Nationale de l'Informatique et des Libertes (CNIL) has imposed a fine of €3m on the company VOODOO, for breaching Article 82 of the French Data Protection Act on 29 December 2022. The CNIL observed that VOODOO, which publishes video games for smartphones, read the technical identifier associated to this user (IDFV) and still processed the information linked to the browsing habits for advertising purposes, when a user refused the advertising tracking, therefore without consent, contradicting what it showed in the information screen it displays. The CNIL concluded the use of the IDFV for advertising purposes without the user's consent constituted a breach.
