The House of Lords Secondary Legislation Scrutiny Committee has published its Twenty Fourth Report of Session 2024–2025. At its meeting, the Committee scrutinised several instruments in accordance with Standing Orders, drawing two statutory instruments to the special attention of the House. The first instrument, the Draft Contracts for Difference (Miscellaneous Amendments) (No. 2) Regulations 2025, proposes to extend the Government’s Contracts for Difference scheme to existing large-scale biomass electricity generators to address anticipated security of supply risks beyond 2027. This instrument is intended to enable continued support for eligible generators on a value-for-money basis, with a particular emphasis on arrangements for the Drax power station, although the explanatory memorandum does not explicitly mention Drax. The Committee noted that external submissions and the House of Commons Public Accounts Committee have raised concerns regarding the environmental sustainability of biomass power generation and the adequacy of current compliance and assurance mechanisms. The second instrument, the Motor Vehicles (Driving Licences) (Amendment) (No. 4) Regulations 2025, establishes a maximum fee for the off-road manoeuvres test conducted by Driver and Vehicle Standards Agency examiners and third-party providers, thereby correcting an issue in which fees had been imposed without statutory authority. The Committee expressed concern over the continuation of fee charges and the need for improved administrative processes to prevent similar oversights in the future. The report also contains information on amendments to the Russia (Sanctions) (EU Exit) Regulations 2025, SI 2025/504 and the Syria (Sanctions) (EU Exit) Regulations 2025, SI 2025/507, which have significant legal and policy implications.
