The Royal Institution of Chartered Surveyors (RICS) has updated its answers to a number of frequently asked questions (FAQs) regarding the Building Safety Act 2022 (BSA 2022). RICS has clarified how the Leasehold and Freehold Reform Act 2024 (LFRA 2024), which received Royal Assent on 24 May 2024, impacts the BSA 2022. RICS has stated that Part 8 of the LFRA 2024 comprises amendments to Part 5 of the BSA 2022, including the repeal of section 125. These changes affect the application of cost recovery and remediation orders and remediation contribution orders for defects. These changes also deal with notifications by insolvency practitioners about Accountable Persons, and recovery of legal fees through service charges. The amendments to the BSA 2022 came into effect on 24 July 2024.

The Royal Institution of Chartered Surveyors (RICS) has published two updated documents to guide valuation professionals in applying the Basel 3.1 framework to bank lending valuations. The Practice Information (Global), effective immediately, offers global guidance on prudently conservative valuation criteria, recognising national regulatory differences and promoting consistent, research-based approaches.

The Royal Institute of Chartered Surveyors (RICS) has republished a Building Safety Regulator (BSR) update to inform members that work has been immediately suspended on more than 50 building projects following the compulsory liquidation of the private registered building control approver AIS Surveyors. The pause affects specific ‘in flight’ projects which were going through approvals with the private building control company prior to the new legislation coming into force in October 2023. Affected projects will need to apply to the HSE/BSR and stop work until they have validated applications. The BSR anticipates that this immediate and substantial increase in their workload is likely to cause delays across the wider profession.

The Royal Institution of Chartered Surveyors (RICS) has welcomed the introduction of the Building Safety (Wales) Bill, which establishes a new safety regime for multi-occupied residential buildings. RICS highlights several key differences between the Welsh Bill and the UK Building Safety Act 2022 (BSA 2022). The Welsh Bill applies to all multi-occupied residential buildings with two or more units, regardless of height, whereas the BSA 2022 primarily applies to higher-risk buildings over 18 metres or seven storeys. The Bill also expands the definition of higher-risk buildings to include hospitals, care homes and children's homes, while the BSA 2022 focuses solely on residential buildings. Regulatory oversight also differs: in Wales, local authorities will regulate the occupation phase, and the Health and Safety Executive (HSE) will oversee registration, whereas in England, the HSE's Building Safety Regulator oversees both construction and occupation phases.

PRACTICE NOTES
Introduction and background This Practice Note provides an overview of the ‘RIIO-2’ Great Britain energy network company price controls which came into effect on 1 April 2021 for gas distribution, gas and electricity transmission and the Electricity System Operator (ESO). This Practice Note will continue to be updated as the position evolves. RIIO (Revenues = Incentives + Innovation + Outputs) refers to the methodology through which the Office of Gas and Electricity Markets (Ofgem) determines the prices that Great Britain’s licensed onshore energy network owners and operators can charge for the use of the electricity and gas transmission networks. These charges are, in the first instance, paid to network companies by licensed suppliers and generators/gas shippers (under the Connection and Use of System Code, the Distribution Connection and Use of System Agreement and the Uniform Network Code). However, they are ultimately passed on to customers through energy supply bills, of which the charges make up a significant portion. For an introduction to the legal
