Restructuring & Insolvency analysis: It is rare that a bankrupt will receive a substantial sum of money which might be claimed by a trustee in bankruptcy as after-acquired property. Rarer still is a case where a bankrupt receives such a sum, and then goes to every possible length to hide the receipt of the sum from his trustee. This was exactly that case. The court held that a sum of money paid to the bankrupt’s son’s solicitors pursuant to a Settlement Agreement was entirely beneficially owned by the bankrupt, and that none of the various parties who had subsequently received part of that sum had done so in good faith, for value and without notice of the bankruptcy. The trustees in bankruptcy therefore succeeded in their case that the entirety of the sum had been claimed as after-acquired property by the service of the relevant notice.
