PRACTICE NOTES
Forfeiture provisions in rack-rented occupational leases are commonly accepted; this is because those leases rarely have capital value. However, long leases (which usually have a minimal ground rent) are considered to be more akin to freeholds and are likely to have a substantial capital value (with a substantial premium often having been paid on the grant of them). Lenders who take mortgage security over long leases are therefore keen to ensure that either: • the lease does not contain a right for the landlord to forfeit, or • sufficient protections for the lender are built into any forfeiture provision Mortgagee’s rights on forfeiture If the breach that triggers the landlord’s right to forfeit is non-payment of rent, a mortgagee can apply either for relief from forfeiture (as if it were an undertenant) or for a vesting order (see Law of Property Act 1925 (LPA 1925), s 146(4)). Where forfeiture arises in relation to a breach of any other covenant, the court has a statutory discretion either to grant a mortgagee of the property relief from forfeiture

GLOSSARY
A costing model based on LRIC (long run incremental costs) analysis, in which the total traffic costs for both interconnecting carriers are divided by the total demand, rather than assigning unique costs to each communications provider.
GLOSSARY
The costs caused by the provision of a defined increment of output, taking a long run perspective, assuming that some output is already produced. The 'long run' means the time horizon over which all costs (including capital investment) are variable.
GLOSSARY
Insurance of risks in respect of which claims may not be notified or settled until a relatively long time after the policy period expires (eg asbestos related illness on losses occurring policies).
GLOSSARY
LTIP is an acronym for ‘long-term incentive plan’, which is a term that is commonly used among listed companies to describe an executive share incentive plan under which share-based awards are made to senior employees with a vesting period of at least three years.

Planning analysis: The government has published a substantially revised version of the National Planning Policy Framework (NPPF). As expected, the new NPPF separates plan-making and decision-making policy and makes significant changes to the presumption in favour of sustainable development, development around well-connected stations, housing density, green belt policy, and viability. A consultation response, published on the same day, confirms that the government has taken forward most of the proposals consulted on in December 2025, albeit with a number of significant changes. These include a revised approach to minimum densities around stations, wider application of the policy supporting development around well-connected stations, new provisions for strategic sites and changes to Protected Landscapes. This analysis provides an overview of the main changes to English national planning policy introduced by the new NPPF. More detailed analysis on the implications for decision-making and plan-making will follow.
