GLOSSARY
A judge advocate is the specialist judge who presides over UK service courts, principally the Court Martial and the Service Civilian Court. In practice, a judge advocate is a civilian judicial office-holder, independent of the chain of command, who manages the trial, rules on law and procedure, admits or excludes evidence, directs the lay board (service members) on legal issues and the route to verdict, and ensures compliance with the Armed Forces Act 2006 and fair trial standards. Findings in the Court Martial are returned by the board; the judge advocate gives legal directions and sums up. Sentencing and ancillary orders are imposed as provided by statute and rules, sometimes with the board and sometimes by the judge advocate sitting alone; in the Service Civilian Court the judge advocate sits alone. The office and functions are provided for by the Armed Forces Act 2006 and secondary legislation (including the Armed Forces (Court Martial) Rules 2009). Judge advocates are appointed by the Lord Chancellor; the Judge Advocate General leads the cadre.Usage and powers are consistent across England & Wales, Scotland and Northern Ireland as part of the UK Service Justice System. In Ireland, the equivalent role is performed by the Military Judge under the Defence Acts; “judge advocate” is not the current term.
