The G15 group has published guidance outlining requirements for Section 106 (S106) agreements between developers and housing associations. The report, authored by L&Q, emphasises early collaboration and ongoing engagement between parties. It responds to declining housing association uptake of S106 agreements, with Home Builders Federation data showing 17,000 affordable homes unbuilt due to lack of bids. The guidance is supported by the Chartered Institute of Housing, National Housing Federation, and Homes England, following the launch of Homes England's S106 Affordable Housing Clearing Service in 2024.

Arbitration analysis: The Commercial Court granted an anti-suit injunction restraining Brazilian proceedings brought by a subrogated cargo insurer, holding with a high degree of probability that London arbitration clauses contained in booking notes had been validly incorporated into bills of lading. The court confirmed that a subrogated insurer is bound by the same arbitration obligations as the insured and reaffirmed that delay will not ordinarily defeat anti-suit relief unless foreign proceedings have advanced sufficiently to engage comity concerns. The decision provides useful guidance on incorporation by reference where no conventional charterparty exists and reinforces the English courts’ robust protection of contractual agreements to arbitrate.
