The House of Commons Treasury Select Committee has published the response of the Financial Conduct Authority (FCA)  to the Committee’s recommendations following its ‘Sexism in the City’ inquiry.  The FCA outlines actions taken since the 2024 inquiry and confirms that it will decide by the end of 2025 whether to issue additional guidance on non-financial misconduct (NFM) following changes to COCON published in July 2025. The regulator notes that while further guidance could help firms interpret the rules, it would be indicative rather than prescriptive and could increase compliance costs. The FCA confirms that 76 supervisory cases related to NFM are currently open, including one enforcement case (Odey) referred to the Upper Tribunal. The total number of supervisory cases concerning NFM per year since 2022 show an upward trend, reflecting the FCA’s focus on cultural and conduct issues.

Due to a lack of consensus, the FCA will not shift from an exceptional circumstances test to a public interest test for announcing investigations into regulated firms. Instead, the FCA will confirm investigations already in the public domain, notify the public about potentially unlawful activities of unregulated firms and regulated firms operating outside the regulatory perimeter, and publish more detailed issues under investigation anonymously. The FCA’s final policy will be published by the end of June 2025.
