The Financial Conduct Authority (FCA) has updated its webpage on consultation paper CP23/27: Reforming the commodity derivatives regulatory framework to note that, in line with HM Treasury’s provisions to delay the commencement date of articles 2(2), (3) and (4) of the Financial Services and Markets Act 2000 (Commodity Derivatives and Emission Allowances) Order 2023, the FCA will in turn delay revoking the UK version of delegated regulation (EU) 2017/592 (RTS 20) for the time being. The FCA says it will also not be taking forward the proposals made in CP23/27 relating to the ancillary activity exemption.

The Financial Conduct Authority (FCA) has published an updated Enforcement Information Guide (August 2025), reflecting its new Enforcement Guide (ENFG).  The Information Guide provides a high level overview of the FCA’s enforcement powers under the Financial Services and Markets Act 2000 (FSMA 2000) and its typical process for enforcement cases.

The Financial Conduct Authority (FCA) has updated its webpage on the notification and disclosure of net short positions. The updates include an updated UK List of Exempted Shares, which applies to all positions effective from 1 April 2025, following the second stage of its biannual review. The webpage also mentions the publication of the final Short Selling Regulations 2025 in January 2025 which set out high level requirements for the new UK short selling regime. The FCA says that certain aspects of the regulation will be implemented once the new rules are finalised and it has made any necessary technical and operational changes. The FCA aims to consult on the new short selling rules in Q3 2025.

The Financial Conduct Authority (FCA) has updated its website with certain new information and published updated forms and checklists following the new UK listing regime coming into force on 29 July 2024.  The forms and checklists now include reference to the UK Listing Rules and references to the Listing Rules (which have now been revoked) have been deleted.

The Financial Conduct Authority (FCA) has published an updated direction modifying the UK's derivatives trading obligation (DTO).  It is effective from 31 December 2024. The direction will continue to allow firms subject to the UK DTO, trading with, or on behalf of, EU clients subject to the EU DTO, to transact or execute those trades on EU venues, providing they meet certain conditions. The direction is accompanied by an explanatory note.

The Financial Conduct Authority (FCA) has published updated finalised guidance FG25/4, revising its approach to the Financial Policy Committee’s recommendation on loan to income (LTI) ratios in mortgage lending. Effective 11 July 2025, the guidance raises the de minimis threshold for firms from £100m to £150m of mortgage lending over four consecutive quarters. Firms exceeding this threshold are required to ensure that no more than 15% of their regulated mortgage contracts in any rolling four-quarter period have an LTI ratio of 4.5 or higher. The FCA intends to monitor compliance using product sales data and may intervene under section 55L of the Financial Services and Markets Act 2000 if firms fail to meet expectations.

The Financial Conduct Authority (FCA) has published an updated policy statement on statutory investigations into regulatory failure and the production of reports, setting out the circumstances in which the FCA must investigate and report to HM Treasury (HMT) under Part 5 of the Financial Services Act 2012. The revised statement reflects developments since 2013 and incorporates a secondary objective requiring the FCA to support the international competitiveness and long-term growth of the UK economy. The updated statement applies to events occurring on or after 14 November 2025.

The Financial Conduct Authority (FCA) has published a webpage providing information for firms planning to offer crypto exchange traded notes (cETNs) to retail consumers following the lifting of the retail ban on 8 October 2025. Retail consumers now have access to cETNs when these products are listed on the FCA's Official List and admitted to trading on a UK Recognised Investment Exchange, with prospectuses subject to review and approval before products become available.
