Employment analysis: The government has published the Employment Rights Act 2025 (Commencement No. 1 and Transitional and Saving Provisions) Regulations 2026, which brings into force the provisions of the Employment Rights Act 2025 (ERA 2025) related to the repeal of the Workers (Predictable Terms and Conditions) Act 2023, the extension to the ban on exclusivity terms in zero hour contracts and provisions of various other sections which will enable secondary legislation to be made.

This Practice Note provides a summary of the provisions of the Employment Rights Act 2025 (ERA 2025), which received Royal Assent on 18 December 2025 and was published on 19 December 2025. It provides an overview of the topics covered by ERA 2025, the relevant sections and/or Schedule details, a brief overview of the relevant provisions, whether further consultation and/or secondary legislation is required, and links to Practice Notes that set out further details on the current position. The Practice Note also summarises consultations issued on matters covered by the ERA 2025 and gives details of commencement provisions (see: Consultations issued relating to the ERA 2025, below). The Employment Rights Act 2025 overview factsheet, published on 18 December 2025, confirmed that: • ERA 2025 will be delivered in phases across a two-year period • common commencement dates (6 April and 1 October) will be used to commence the majority of regulations laid using the powers provided for in ERA 2025 • the government remains committed to the timelines set out in the Implementing the Employment Rights Bill Roadmap,

Employment analysis: This analysis summarises the four consultations launched 23 October 2025 relating to the Employment Rights Bill as part of the Make Work Pay initiative on labour market reform. The consultations cover the duty to inform workers of their right to join a trade union, the trade union right of access to workplaces, enhanced workplace protections against dismissal for pregnant women and new mothers and a new entitlement to bereavement leave, including for pregnancy loss before 24 weeks.

Employment news analysis: The House of Commons has today (5 March 2025) published a document which lists all amendments tabled to the Employment Rights Bill (ERB) ahead of the report stage which is due to commence on 11 March 2025, including both government and non-government amendments. The amendments proposed by the government are wide-ranging and include: (1) an extension of the right to be offered a guaranteed hours contract to agency workers, (2) changes to the protected period for collective redundancy consultation, (3) a duty to keep records relating to annual leave, (4) an extension of the regulation of employment businesses, (5) changes to trade union legislation, (6) a power for the Secretary of State to issue notices of underpayments, (7) changes to Statutory Sick Pay (SSP), and (8) changes to collective redundancy consultation.
