The European Securities and Markets Authority (ESMA) published a thematic note on 1 July 2025 promoting clarity in sustainability-related claims used in non-regulatory retail communications. Aimed at helping market participants avoid misleading investors, the note sets out four guiding principles and examples of good and poor practices regarding references to sustainability credentials such as labels or awards. While it introduces no new legal obligations, it aligns with earlier guidance from European Insurance and Occupational Pensions Authority (EIOPA) and the European Banking Authority (EBA).

They cover written arrangements between members of resolution colleges envisaged in Regulation (EU) 2021/23 of the European Parliament and of the Council (CCPRRR) and in Commission Delegated Regulation (EU) No 2023/1192 supplementing Regulation (EU) 2021/23 of the European Parliament and of the Council with regard to technical standards specifying the content of the written arrangements and procedures for the functioning of the resolution colleges (the Resolution College Delegated Regulation).

The European Securities and Markets Authority (ESMA) has published an updated list detailing the grandfathering periods adopted by Member States under Article 143 of the Markets in Cryptoassets Regulation (Regulation) (EU) 2023/1114) (MiCA). These transitional measures allow cryptoasset service providers (CASPs) that were operating in accordance with applicable national law before 30 December 2024 to continue their activities temporarily—until 1 July 2026 or until they are granted or refused authorisation under Article 63 of MiCA, whichever comes first.

The European Securities and Markets Authority (ESMA) has published guidelines on certain aspects of the suitability requirements and format of the periodic statement for portfolio management activities under the Markets in Cryptoassets Regulation (Regulation (EU) 2023/1114) (MiCA), alongside official translations. In particular, the guidelines aim to promote greater convergence in the application of, and supervisory approaches to, the MiCA suitability requirements and requirements applicable to the format of the periodic statement to be provided by crypto-asset service providers providing portfolio management of cryptoassets. As the official translations have now been published on the ESMA website, the guidelines will apply in two months’ time at which point competent authorities to which these guidelines apply must notify the ESMA, whether they (i) comply, (ii) do not comply, but intend to comply, or (iii) do not comply and do not intend to comply with the guidelines.
