In 2022, the AAA Commercial Arbitration Rules and Mediation Procedures including the Procedures for Large, Complex Commercial Disputes (the Commercial Rules or the AAA Commercial Rules) were revised. The new AAA Commercial Rules are in effect as from 1 September 2022. The 2022 rules apply if the administrative requirements are met for a Demand for Arbitration on or after 1 September 2022, or a Submission Agreement is received by the AAA on or after 1 September 2022. (R.1(a)). The 2022 version of the Commercial Arbitration Rules continues to use the fee schedule in effect as at 1 May 2018. Roles of the parties and the institution in arbitrator selection If the agreement of the parties names an arbitrator(s) or specifies a method of appointment, that designation or method will be followed. (R.14(a)). If any party fails to make the appointment as required, the AAA will make the appointment. If the agreement fails to specify a time for making the party appointment, the AAA will notify the party to make the appointment

The American Arbitration Association (AAA) has announced a strategic alliance with Newcode to integrate AAA alternative dispute resolution (ADR) clauses directly into Newcode’s artificial intelligence (AI)-powered legal drafting platform. The collaboration will enable legal and business teams to incorporate AAA ADR clauses into contracts, workflows and AI-assisted drafting processes at the point of drafting. According to the AAA, the integration is intended to support the use of clear and effective dispute resolution clauses, reduce drafting ambiguity and improve procedural alignment in the event of disputes. Newcode’s platform allows users to build AI agents to draft, analyse and refine arbitration and mediation language in a confidential, auditable environment. The initiative forms part of the AAA’s broader efforts to expand access to its arbitration resources through legal technology partnerships.

It highlights the AAA-ICDR's guidance requiring arbitrators to disclose generative AI use that could materially affect proceedings, as well as the Chartered Institute of Arbitrators' guidelines encouraging early disclosure of planned AI use. These measures reflect a broader emphasis on fairness, transparency and informed party consent.

The American Arbitration Association (AAA) has introduced AI Led Arbitration Rules establishing a hybrid system where an AI Arbitrator makes preliminary decisions that are reviewed and finalised by human arbitrators. The rules apply to two-party disputes processed through AAA's Digital Dispute Resolution Center platform, with filing costs of $US 2,500 per claim or counterclaim and streamlined submission schedules of ten business days per stage.

The American Arbitration Association (AAA) has launched its Artificial Intelligence (AI) Ambassador programme, bringing together selected AAA arbitrators and mediators to examine emerging legal and procedural issues arising from the use of AI in dispute resolution. The programme is organised into four working groups covering AI evidence and arbitration procedure, emerging AI disputes, AI-driven commerce and automated transactions and digital assets and algorithmic finance. The working groups will develop practical resources for alternative dispute resolution (ADR) users, counsel, arbitrators, mediators and other dispute resolution professionals, including articles, white papers, webinars and other educational materials. Areas of focus include the authenticity of AI-related evidence, AI hallucinations, automated commercial transactions and algorithmic finance. The programme also forms part of the AAA’s wider work on the impact of emerging technologies on disputes and dispute resolution processes and is intended to support the responsible use of AI in arbitration and mediation.

The American Arbitration Association (AAA) has announced the launch of its ‘Resolution Simulator’, an artificial intelligence (AI)-powered tool designed to deliver non-binding simulated decisions in documents-only commercial and construction disputes. The tool expands the functionality of the AAA’s AI Arbitrator platform, applying the same structured legal reasoning and analytical framework to generate a simulated outcome based on a user’s submissions and feedback. Designed for single-party use, it provides explainable, informational insights intended to help parties understand how an arbitrator may analyse and resolve a dispute, assess potential exposure, and evaluate legal or negotiation strategy before commencing formal proceedings. The simulator may also assist with internal discussions with clients or counsel and inform consideration of alternative resolution pathways, such as settlement or mediation. According to the AAA, the Resolution Simulator responds to user demand for practical evaluative and decision-support tools, particularly at the early stages of a dispute, and will be showcased alongside other AI solutions at Legalweek 2026.
