TMT analysis: The High Court has granted an application for an interim injunction in malicious falsehood by a manufacturer of stabilisers for caravans, resulting in the removal from the internet of videos made by a rival company owner which referred to the claimant, the claimant’s company, and the product in a derogatory way. An application to prevent further breaches of the Data Protection Act 1998 by the defendant in relation to the use of promotional videos the claimant had produced for a trade fair was also allowed. When considering the claim for malicious falsehood, the court held that all of the statements made by the defendant (which included statements to the effect that the stabilisers were inherently unsafe, that the claimant company was knowingly risking the lives of the public by selling them, that the claimant company was a fraudulent business and that its marketing manager had told lies) were obviously untrue.
