School definition

What does School mean?

An educational institution providing primary and/or secondary education.

If the educational institution which provides primary and/or secondary education also provides further education, that institution will still be referred to as being a school. A maintained nursery is also a school, though a nursery which is not maintained is not a school. A 16-19 Academy is not a school whereas an alternative provision academy is a school. See the Education Act 1996, s 4.

'School organisation' is the label given collectively to the various statutory processes involved in opening, altering and closing maintained schools.England—establishing a new state-funded schoolA local authority perceiving a need for a new state-funded school in its area must publish a notice under section 6A of the Education and Inspections Act 2006 (EIA 2006), inviting proposals for a new academy (commonly known as the ‘free school presumption’). The Department for Education (DfE) has produced guidance on how the free school presumption process should operate in practice. The local authority is responsible for providing the site for the new school and meeting all associated capital and pre- or post-opening revenue costs. This Practice Note applies in England only. There are no free schools in Wales. Although the Academies Act 2010 (AcA 2010) does apply in Wales, the provisions for the creation and funding of new free schools apply only in England.This new category of independent school was created in 2010. Local Government analysis: The claimant’s mother applied for judicial review of the Council’s decision refusing her request to be accompanied by a solicitor at a meeting to review her son’s individual development plan (IDP) which made provision for his additional learning needs under the Additional Learning Needs and Education Tribunal (Wales) Act 2018 (ALNET(W)A 2018). The Court of Appeal concluded that the Act required an authority to have regard to how to facilitate a child’s and their parent’s involvement in the review process but there was no statutory right to be accompanied by a solicitor at the review meeting. Changes to NDAs under the Victims and Prisoners Act 2024

Information Law analysis: The Victims and Prisoners Act 2024 (VPA 2024), section 17 comes into effect on 1 October 2025. The provision codifies common law protections for the reporting of crime to the police and whistleblowing in relation to criminal activity. It also expands the liberty of victims of crime to make certain further disclosures without risk of enforcement of non-disclosure agreements (NDAs). The scope of permitted disclosures includes those made for the purposes of seeking legal advice, co-operating with regulatory investigations and seeking support from certain persons in relation to the relevant conduct, which include, among others, victim support services, and the close family of the person making the disclosure.
