Compensation orders in criminal cases The procedural rules relating to the criminal courts’ powers to make compensation orders are contained in sections 133–146 of the Sentencing Act 2020 (SA 2020) (also known as the Sentencing Code). For information on the introduction and applicability of SA 2020, see Practice Note: Sentencing Code. When sentencing a convicted offender, the sentencing court will consider whether a compensation order should be made in favour of the victim(s). Compensation orders may be made instead of, or in addition to another sentence and can be made against both individual and corporate defendants. Applicable offence specific guidelines issued by the Sentencing Council specifically direct the courts to consider compensation to the victims of crime. Sentencing Code This Practice Note explains the scope of the Sentencing Code which was created by the Sentencing Act 2020 (SA 2020) and which, since 1 December 2020, provides the single consolidated law on sentencing criminal offences in the courts in England and Wales. What is the Sentencing Code? The Sentencing Code is the name given to SA 2020 (Pts 2–13) which together comprise the consolidated rules of procedure for the sentencing of criminal offences by the criminal courts in England and Wales. All offenders convicted on or after 1 December 2020 must be sentenced under the provisions of the Sentencing Code, regardless of the date when the offence was committed. Criminal lawyers practising in the criminal courts should be familiar with the Sentencing Code in conjunction with the Criminal Procedure Rules 2020 (CrimPR 2020), SI 2020/759 and any applicable sentencing guidelines whenever representing individuals or corporate bodies convicted of offences.
