It can contribute to: creating high-quality places, ensuring functionality and usability, promoting sustainability, helping to preserve the local character of an area, facilitate community engagement and promote well-being within communities. Considering design when preparing a planning application is particularly important in light of paragraph 139 of the National Planning Policy Framework (NPPF), which states that development that is not well-designed should be refused, especially where it fails to reflect local design policies and government guidance on design, taking into account any local design guidance and supplementary planning documents such as design guides and codes—see ‘LPA’s determination of planning application’ below. Moral rights The nature of moral rights The Copyright, Designs and Patents Act 1988 (CDPA 1988) confers a number of personal rights on authors that are additional to their economic rights. These are known as moral rights. While copyright deals with economic interests, moral rights are about the reputation and integrity of the author that is publicly associated with the work. Reference is sometimes made to ‘copyright and associated rights’—moral rights are a subcategory of these ‘associated rights’. While distinct from copyright, they do not arise where copyright does not arise. Article 6bis(1) of the Bern Convention provides: '(1) Independently of the author's economic rights, and even after the transfer of the said rights, the author shall have the right to claim authorship of the work and to object to any distortion, mutilation or other modification of, or other derogatory action in relation to, the said work, which would be prejudicial to his honor or reputation.' Can local planning authorities accept outline planning applications with parameter plans marked as illustrative? What is an outline planning permission? The purpose of an outline planning permission is to enable a developer to obtain confirmation from the local planning authority (LPA) that a particular form of development on a site is acceptable in principle, and to reserve the details of that development for subsequent approval. Section 92 of the Town and Country Planning Act 1990 (TCPA 1990) provides: '"Outline planning permission" means planning permission granted, in accordance with the provisions of a development order, with the reservation for subsequent approval by the local planning authority, the Welsh Ministers or the Secretary of State of matters not particularised in the application (“reserved matters”).'
