MVNO agreement—checklist This Checklist covers some of the main provisions to be included in a mobile virtual network operator (MVNO) agreement under which a mobile network operator supplier will provide wholesale access services to an MVNO for resale to its own retail customers. It covers some of the main provisions that are specific to an agreement of this kind. See also the Precedent: MVNO agreement. In this Checklist, the following definitions are used: • Agreement—means the MVNO agreement between the MVNO and the Supplier for the provision of the Services • End-User—means a customer of the MVNO • IPR—means intellectual property rights • MVNO—means mobile virtual network operator, the customer in the Agreement • Services—means the wholesale network services being provided to the MVNO by the Supplier • Supplier—means the mobile network operator providing network services to the MVNO The third column can be used to record observations or comments as the Checklist is worked through. Net neutrality in the EU This Practice Note explains how the principle that use of the internet should be kept free from any sort of discrimination, commonly known as ‘net neutrality’, has been implemented into EU legislation. This includes consideration of the provisions in Regulation (EU) 2015/2120 (commonly known as Roaming IV, or the Open Internet Regulation) that implemented net neutrality. It also includes consideration of how the legislation applies to some common practices such as blocking, throttling and use of zero-rating/zero-tariff contracts. The expression ‘net neutrality’ refers to a principle according to which use of the internet should be kept free from any sort of discrimination—therefore, providing equal opportunities of access to any user. Radio spectrum regulation Use of radio spectrum in the UK, Channel Islands and Isle of Man is regulated by Ofcom under the Communications Act 2003 (CA 2003) and the Wireless Telegraphy Act 2006 (WTA 2006). This Practice Note covers Ofcom’s functions and duties in regulating the spectrum, as well as licensing of the spectrum and enforcement. Ofcom’s functions and duties In carrying out its functions, Ofcom’s principal duty is 'to further the interests of citizens in relation to communications matters' and 'to further the interests of consumers in relevant markets, where appropriate by promoting competition.' The electromagnetic spectrum comprises the range of wavelengths or frequencies over which electromagnetic radiation extends. Among other things, Ofcom’s principal duty therefore requires it to secure optimal use of the electromagnetic spectrum for wireless telegraphy. In performing its duties, Ofcom must have regard in all cases to principles of transparency, accountability, proportionality and consistency and must target regulation only at cases in which action is needed.
