Chapter I prohibition definition

What does Chapter I prohibition mean?

A reference to the prohibition in the Competition Act 1998 (CA 1998), s 2 against agreements between undertakings, decisions by associations of undertakings or concerted practice which may affect trade within the UK and have as their object or effect the prevention, restriction or distortion of competition within the UK.

Substantively the same prohibition as is found in Article 101(1) TFEU with the exception of the jurisdictional element. CA 1998, s 2 also provides a non-exhaustive list of prohibited practices including: a) directly or indirectly fixing purchase or selling prices or other trading conditions; b) limiting or controlling production, markets, technical development or investment; c) sharing markets or sources of supply; d) applying dissimilar conditions to equivalent transactions with other trading parties; and e) making the conclusion of contracts subject to the acceptance by the other parties of supplementary obligations which have no connection with the subject of the contracts. CA 1998, ss 6-11 provide for exemptions from the Chapter I prohibition.
