This checklist looks at the typical insurance policies that will be required, and which party will usually be responsible for taking them out. • All risks—Most standard form building contracts require all risks insurance (often referred to as contractor's all risks or CAR cover) to be taken out to cover physical damage and/or loss of the works, which will include materials. General insurance types Consumer insurance and commercial insurance for businesses This Practice Note provides an overview of some of the most common types of insurance that are available, who might need them, and how they work. Generally speaking, insurance is divided into two categories: (a) insurance for consumers and (b) insurance for businesses. For consumers, the relevant statutory regime is the Consumer Insurance (Disclosure and Representations) Act 2012 (CI(DR)A 2012). CI(DR)A 2012 defines a consumer as an ‘individual who enters into the contract wholly or mainly for purposes unrelated to that individual’s business trade or profession’. The CI(DR)A 2012 deals with the issue of what a consumer must tell an insurer before entering into or varying an insurance contract. Court of Appeal considers scope of the VAT exemption for insurance intermediary services (WTGIL v HMRC)

Tax analysis: In WTGIL Ltd, the Court of Appeal decided that, where an insurance intermediary has supplied intermediary services in relation to car insurance policies that require it to provide and fit devices to the cars concerned, the provision and fitting of the devices by the intermediary is an exempt activity carried out ‘in the course of’ acting in an intermediary capacity. The Court found the services fell within the scope of Item 4 of Group 2 of Part II of Schedule 9 to the Value Added Tax Act 1994 (VATA 1994) which provides exemption for the services of an insurance intermediary that are related to a contract for insurance and are supplied by the insurance intermediary ‘in the course of’ acting in an intermediary capacity.
