Pollution incidents and investigations

A pollution incident is when any substance is released to land, air or water that could harm people or the environment. The scope, urgency and organisation of responses to pollution incidents depends on their nature and scale. Major incidents may require a multi-agency response coordinated in accordance with national civil contingency plans and the UK Resilience Emergency Response and Recovery Guidance, involving:

fire and rescue services
•
health bodies
•
HM Coroner
•
local authorities (LAs)
•
government agencies and other non-departmental public bodies (NDPBs)
•
the Armed Forces
•
the private sector
•
the voluntary sector, and
•
the community

For the most severe emergencies, government may invoke emergency powers under Civil Contingencies Act 2004, Part 2. Emergency powers are a last-resort option for responding to the most serious of emergencies where existing legislative provision is insufficient. They are a mechanism for making temporary legislation in order to prevent, control or mitigate an aspect or effect of the emergency.

EA publishes annual pollution incident report for 2016– 2024

The Environment Agency (EA) has published its annual pollution incident report for 2016 to 2024, along with supporting data annexes. It presents data and analysis of sector and company-specific pollution incident performance across the nine water and sewerage companies operating in England. The report sets out the persistently poor pollution incident performance of the sector. It notes that, at a time of growing public interest in the health of rivers, lakes and seas, the water industry must do more to prevent pollution and respond rapidly when it occurs. The EA’s expectations for 2020 to 2025, set out in the Water Industry Strategic Environmental Requirements (WISER), include a trend to zero serious pollution incidents, a reduction in all pollution incidents and high levels of self-reporting. The report shows that serious pollution incidents (categories 1 and 2) increased by 60% in 2024, from 47 in 2023 to 75—the highest number recorded during the reporting period. All pollution incidents (categories 1 to 3) rose by 29% to 2,801 in 2024, a 47% increase compared to 2016.

Council delays battery due diligence rules to support EU industry readiness

The Council of the EU has adopted a new regulation postponing the application of due diligence obligations under the EU Batteries Regulation (Regulation (EU) 2023/1542) from 18 August 2025 to 18 August 2027. The delay, part of the ‘Omnibus IV’ simplification package, gives producers and exporters of batteries more time to comply with environmental and waste-related requirements, and addresses delays in authorising third-party verification bodies. The regulation also mandates the European Commission to publish due diligence implementation guidelines by 18 August 2026 to support smooth and timely compliance. The regulation will be published in the Official Journal of the European Union in the coming days and will enter into force the day after publication.

MHCLG updates guidance on Planning and Infrastructure Bill

The Ministry of Housing, Communities and Local Government (MHCLG) has updated its guidance on the Planning and Infrastructure Bill. The update includes new documentation, such as government amendments introduced during the House of Lords Committee Stage of the Bill, and correspondence between the Minister of State for Housing and Planning, Matthew Pennycook, and the Office for Environmental Protection concerning amendments to the Nature Restoration Fund provisions in Part 3 of the Bill.
