At this juncture it becomes critical to determine the precise level of union membership in the bargaining unit. If the employer does not contest the membership figures claimed by the union, the CAC may accept them at face value (eg GMB and J Chadwick (Transport) Ltd (TUR1/353/03, 22 April 2004), CAC; CWU and Colt Telecom Group plc (TUR1/590/07, 14 September 2007), CAC; ATL, NASUWT, NUT, ASCL & NAHT and United Church School Trust (TUR1/611/07, 18 January 2008), CAC; NUJ and South West Wales Media Ltd (TUR1/630/08, 22 April 2008), CAC). Occasionally there may be independent evidence of the extent of union membership as a result of an ACAS or other such survey (Amicus and Lodige Integral (TUR1/441/05, 18 April 2005), CAC).
