199. Statutory procedure for abatement of a nuisance.

In relation to those matters declared to constitute a statutory nuisance1, the environmental protection legislation provides a special statutory procedure empowering a court to compel the person responsible2 to take steps to abate the nuisance or to prevent its recurrence3. The statutory procedure may be instigated either by the service of an abatement notice4 by the local authority5 in whose area the statutory nuisance exists or is likely to occur
