In the case of a person who on the date of displacement1 is occupying, or is treated2 as occupying, the dwelling3 by virtue of an interest in it which is an owner's interest4, the amount of the home loss payment5 is 10 per cent of the market value of his interest in the dwelling6 or, as the case may be, the interest in the dwelling vested in trustees, subject to a prescribed maximum amount and minimum amount7. In any other case, the home loss payment is a prescribed amount8.
