Ofcom1 may impose a penalty on a person2 if:
(1) that person is or has been in contravention in any respect of the terms, provisions or limitations of a wireless telegraphy licence3;
(2) Ofcom has notified that person that it appears to it that those terms, provisions or limitations have been contravened in that respect4; and
(3) that contravention is not one in respect of which proceedings for an offence under Chapter 4 of Part 2 of the Wireless Telegraphy Act 20065 have been brought against that person6.
