387.     Overview.

The provisions of the Enterprise Act 2002 that detail the media public interest considerations1 can be subdivided into those that focus on newspaper mergers2, and those that focus on broadcasting and cross-ownership mergers3. To a large extent, the former emulate pre-existing provisions of the Fair Trading Act 1973. The introduction of the latter accompanied the removal of some restrictions on cross-media ownership in the Communications Act 2003. The Secretary of State4 is empowered to publish general advice and information regarding the media
