It is a function of Ofcom1, pursuant to the Communications Act 2003, 2and to the extent that provision for Ofcom to do so is contained in the BBC's Charter and the Framework Agreement3 to regulate the BBC4.
Ofcom's general duties under the Communications Act 20035 apply to the carrying out of its functions contained in the BBC's Charter and the Framework Agreement6; and Ofcom must have regard, in doing so, to such of the following as appear to it to be relevant in the circumstances: (1) the object of the BBC to fulfil its mission and promote the public purposes7;
