It is the duty of Ofcom1 to carry out its functions in relation to local sound broadcasting services2 in the manner that it considers is best calculated to secure: (1) that programmes3 consisting of or including local material4 are included in such services; and (2) that, where such programmes are included in such a service, what appears to Ofcom to be a suitable proportion of them consists of locally-made5 programmes6.
Ofcom must: (a) draw up guidance as to how it considers the requirements of heads (1) and (2) above should be satisfied; and (b) have regard to that guidance in
