The Secretary of State may by order provide for1:
(1) any of the provisions of Part 3 of the Communications Act 20032, to the extent that they relate to television services3; or
(2) any provision of Part I of the Broadcasting Act 19904 or of Part I of the Broadcasting Act 19965 (which regulate television services)6,
to have effect, in relation to services of such descriptions as may be set out in such an order, with such modifications as he considers necessary or appropriate for services of that description7.
The Secretary of State is not to make such an order, however,
