The common law rules relating to party walls and rights of support now only apply in those situations not covered by the Party Wall etc Act 1996 or where the procedures of the Act are not followed1. Under the common law rules, the rights and duties inter se of adjoining owners in respect of party walls depend upon the category into which the party wall falls2 and upon the circumstances of the case.
